Agreement to Terms
These Terms & Conditions ("Terms") govern your use of s-airs.com and all services provided by Smart Aerial Solutions LLC ("SAIRS," "we," "us," or "our"). By accessing our website, submitting an inquiry, booking a service, or engaging us for a project, you agree to be bound by these Terms.

Services
SAIRS provides professional aerial and ground-level visual media and inspection services, including:
- Aerial photography and drone videography
- Real estate photography and interior photography
- Matterport 3D virtual tours and scanning
- Cinematic video production for hospitality and commercial clients
- Drone inspections for telecom towers, powerlines, rooftops, solar installations, and building facades
- Thermal imaging inspections
- Photogrammetry and 2D/3D aerial mapping
- Social media content creation
All services are subject to availability, weather conditions, FAA airspace authorizations, and site access. All shoots and flights must be confirmed in advance between the client and SAIRS before mobilization. SAIRS reserves the right to modify or discontinue any service with reasonable notice.
Service Area
We cover South Florida from Key West to West Palm Beach, including Miami-Dade, Broward, and Palm Beach counties. Services outside this area are available upon request and may incur additional travel fees.
Booking & Payment
Booking Confirmation
A booking is confirmed upon receipt of full payment (Axis Store visual packages) or a signed agreement (custom and inspection projects). All shoots and flights must be confirmed in advance between the client and SAIRS — no mobilization occurs without prior confirmation. We reserve the right to decline any booking at our discretion.
Pricing
Prices are in US Dollars and subject to change. The price confirmed at booking applies to your project. Custom quotes are valid for 30 days unless stated otherwise.
Payment — Visual Packages (Axis Store)
Full payment is required at time of booking, processed securely via credit card through Stripe or PayPal. We accept all major credit cards, PayPal, and Apple Pay. SAIRS does not store payment card data.
Payment — Custom & Corporate Projects
For custom projects, inspections, and corporate engagements, payment terms are agreed upon at the time of contracting. Volume clients may request monthly invoicing. All terms are formalized in a project agreement before work begins.

Weather & Force Majeure
SAIRS monitors weather closely. Drone operations may be postponed due to wind, rain, lightning, or restricted airspace. We notify you as early as possible and reschedule at no charge. SAIRS is not liable for delays caused by weather, FAA Temporary Flight Restrictions (TFRs), or conditions beyond our control.
Delivery
Turnaround Times
- Photos only (real estate, aerial stills): Within 24 hours of shoot completion
- Photos + video (standard packages): Within 24 hours of shoot completion
- Cinematic video & full productions: Within 72 hours of shoot completion
- Matterport 3D tours: Within 48 hours after capture
- Photogrammetry / aerial mapping — imagery delivery: Within 24 hours after capture
- Photogrammetry / aerial mapping — processed outputs (orthomosaic, point cloud, 3D model): Within 48 hours after capture
- Inspection reports: Within 48 hours after flight completion
Delivery Guarantee: For Axis Store packages, if we miss your confirmed delivery deadline, we issue a full refund — no questions asked.
Shoot & Flight Confirmation
All shoots and flights are scheduled and confirmed directly between the client and SAIRS prior to mobilization. Delivery timelines begin from the moment capture is completed, not from the initial booking date.
File Delivery
Files are delivered via a private, watermarked gallery for preview and approval, then released immediately upon payment confirmation. For larger projects, delivery is via secure download link (Google Drive, Dropbox, or WeTransfer), typically active for 30 days. Download and back up files promptly.
Revisions
All packages include one round of editing revisions (color correction, cropping, reordering) at no charge when requested within 5 business days of delivery. Reshoots or significant creative changes are quoted separately.
Matterport 3D Tours — Hosting
Matterport 3D tours require cloud hosting to remain accessible. SAIRS offers the following options:
- SAIRS-hosted (included): Packages that include a Matterport tour come with 3 months of hosting at no additional charge. After 3 months, hosting continues at $15/month per tour if you choose to keep it active under our account.
- Transfer to client account: At any time, the tour can be transferred to your own Matterport account. From that point, hosting is managed and billed directly by Matterport to you.
- Capture to client account: If you already have a Matterport account, we can capture and upload the tour directly into your account. In this case, you manage and pay hosting directly — no intermediate hosting by SAIRS.
Hosting options and preferences should be confirmed at the time of booking. SAIRS is not responsible for tours that become inaccessible due to lapsed hosting on the client's account.
Intellectual Property & Usage Rights
Your License
Upon full payment, you receive a perpetual, non-exclusive license to use delivered media for: MLS listings, your website, social media, print marketing, press, and internal use.
SAIRS Portfolio Rights
Unless requested otherwise in writing prior to the shoot, SAIRS retains the right to use project imagery in our portfolio, website, social media, and marketing. Confidential client information is never disclosed.
Restrictions
- You may not resell or sublicense delivered files as stock media
- Inspection imagery may not be used to misrepresent infrastructure condition
- AI training use of our delivered media requires separate written agreement
Raw Files
Raw/unedited files are not included in any package unless explicitly agreed in a separate contract.
Limitation of Liability
SAIRS provides services "as is." Our total liability for any claim is limited to the amount paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
Insurance
SAIRS carries commercial drone liability insurance through Skywatch. Certificates of Insurance (COI) are available upon request with reasonable advance notice for projects that require them.
Client Responsibilities
You are responsible for: obtaining permission for us to access and fly over the subject property; ensuring site safety; and notifying SAIRS of known hazards, restricted areas, or local ordinances affecting the shoot. Failure to disclose conditions that result in a cancelled or interrupted flight does not entitle the client to a refund.
FAA Compliance & Airspace
All SAIRS drone operations are conducted by FAA Part 107 certified pilots in full compliance with applicable regulations.
- LAANC or FAA waivers obtained for controlled airspace as required
- Flights near airports, heliports, and restricted zones coordinated in advance
- All shoots and flights confirmed in advance between client and SAIRS
- Clients must disclose any known airspace restrictions or hazards at the project site
SMS & WhatsApp Terms
By providing your phone number and opting in through our website or forms, you agree to receive text messages from SAIRS related to your booking, project status, and occasional promotional content.

Disputes & Governing Law
These Terms are governed by the laws of the State of Florida. Disputes shall first be addressed through good-faith negotiation. If unresolved, disputes will be subject to binding arbitration in Miami-Dade County, Florida. You waive the right to participate in class action lawsuits against SAIRS.
Changes to These Terms
We may update these Terms at any time. Material changes will be reflected by the "Last updated" date above. Continued use of our services after changes constitutes acceptance.
