Overview
These Terms & Conditions govern your use of services provided by Smart Aerial Solutions LLC ("SAIRS," "we," "us," or "our"), including s-airs.com, portal.s-airs.com, SAIRS Axis, SAIRS Inspections, Axis Store, Axis Checkout, SAIRS Client Portal, booking update pages, payment pages, client delivery systems, and related communications.
SAIRS provides professional real estate photography, aerial photography, cinematic video, Matterport 3D virtual tours, visual production, drone inspections, thermal imaging, photogrammetry, mapping, and project documentation services across South Florida, including Miami-Dade, Broward, Palm Beach County, Monroe County, and surrounding areas from Key West to West Palm Beach.
By using our website, submitting a form, placing an order, reserving a project, approving a quote, making a payment, accessing the client portal, or receiving SAIRS services, you agree to these Terms & Conditions.
Short version: SAIRS provides professional visual media, Matterport, aerial, and inspection-related services. Bookings are subject to operational review, weather, access, airspace, safety, payment status, and project scope. SMS consent is optional, separate from required booking terms, and not a condition of purchase.

Services
SAIRS services may include HDR photography, interior and exterior photography, aerial drone photography, aerial drone video, cinematic interior video, Matterport 3D virtual tours, floor plans, virtual staging, social media reels, MatterPak files, commercial visual media, hospitality content, roof or façade documentation, telecom inspections, powerline inspections, solar inspections, thermal imaging, mapping, photogrammetry, and infrastructure documentation.
Services are divided generally into two operating areas:
- SAIRS Axis: Real estate, hospitality, commercial visual media, photography, video, Matterport, floor plans, aerial media, and listing content.
- SAIRS Inspections: Technical inspection, documentation, mapping, thermal, utility, telecom, solar, industrial, and infrastructure projects.
Some services may require custom review, scope confirmation, safety evaluation, airspace review, site access confirmation, or separate written approval before work is accepted.
Quotes, Pricing & Packages
Published prices, packages, and add-ons may be shown on s-airs.com, Axis Store, Axis Checkout, proposals, invoices, or client communications. Prices may change without notice unless a booking, quote, or invoice has already been accepted according to its stated terms.
Standard SAIRS Axis packages may include Essential, Signature, Premier, Elite, and Iconic, plus optional add-ons such as Matterport, aerial photos, aerial video, interior video, social media reels, twilight shoots, virtual staging, floor plans, MatterPak, rush delivery, and extra Matterport coverage.
Inspection, enterprise, hospitality, large commercial, multi-property, utility, telecom, solar, industrial, mapping, and infrastructure projects usually require operational review and custom pricing. SAIRS is not obligated to honor automatic checkout pricing for a project that is misclassified, outside standard scope, or requires custom review.
Bookings & Scheduling
Submitting a booking request, checkout form, contact form, payment, reservation, or project inquiry does not guarantee final scheduling. Final scheduling is subject to SAIRS internal review, availability, location, weather, airspace, safety, access, project scope, payment status, and operational capacity.
- Requested dates and times are scheduling preferences until confirmed by SAIRS.
- SAIRS may contact you to confirm access, address, scope, property details, timing, payment, or operational requirements.
- SAIRS may decline, reschedule, modify, or cancel a project if the scope is inaccurate, unsafe, unavailable, restricted, unpaid, inaccessible, or outside operational capability.
- Weekend, rush, large commercial, hospitality, inspection, or complex projects may require additional approval.
Required Booking Information
You are responsible for providing accurate client information, property address, site location, contact details, preferred date and time, package or service selection, access notes, parking details, gate codes, onsite contact information, HOA or building requirements, safety notes, and any special instructions needed to complete the project.
Access, Property Readiness & Client Responsibility
You are responsible for ensuring that the property, site, building, unit, roof, exterior, interior, or project location is ready and accessible at the scheduled time.
- Client must provide legal access and permission to photograph, scan, fly, inspect, enter, or document the property or site.
- Client is responsible for HOA approvals, building permissions, security clearance, rooftop access, property management approvals, tenant coordination, parking, gate codes, lockbox details, onsite contacts, pet control, and alarm handling.
- If the property is not ready, inaccessible, unsafe, restricted, or materially different from the provided scope, SAIRS may reschedule, limit capture, charge an operational fee, or cancel according to the situation.
- A not-ready or no-access fee may apply. The current operational fee is $75 when applicable.
Payments, Invoices & Reserve Now, Pay Later™
SAIRS may accept payment through Stripe, eligible wallet options such as Apple Pay, PayPal, invoices, payment links, or other approved methods. Payment status may affect scheduling, production, delivery, and file release.
SAIRS does not store full credit card numbers, PayPal login credentials, or complete payment card data. Payments are processed by secure third-party payment providers.
Pay Now
If you choose to pay at checkout, your payment confirms that the booking request and payment attempt were received. Payment does not automatically confirm final scheduling until SAIRS reviews and confirms the appointment.
Reserve Now, Pay Later™
Reserve Now, Pay Later™ allows eligible clients to reserve a project without upfront payment, subject to operational review. It is a flexibility option and not a universal entitlement.
For Reserve Now, Pay Later™ projects, SAIRS may complete booking review, scheduling, capture, editing, and delivery preparation before requesting payment. Final files are not released through SAIRS Client Portal until payment is completed and verified.
Invoices
Invoices, receipts, payment confirmations, and payment requests may be delivered by email, client portal, payment page, or other approved communication method. You are responsible for reviewing invoice details and notifying SAIRS promptly if any information appears incorrect.
Cancellation, Rescheduling & Weather
Cancellation and rescheduling requests are reviewed based on timing, project status, weather, access, operational cost, and the circumstances of the request.
- 72+ hours before appointment: May be eligible for full refund or reschedule review according to current policy.
- 24–72 hours before appointment: May qualify for one complimentary reschedule or partial policy handling.
- Less than 24 hours before appointment: Generally not eligible for refund.
- Property not ready or inaccessible: Operational fee may apply. Current fee: $75.
- Weather or FAA issue initiated by SAIRS: Reschedule or refund options may be provided depending on the situation.
Rain, thunderstorms, lightning, excessive wind, unsafe weather, restricted airspace, FAA requirements, Temporary Flight Restrictions, site hazards, or operational safety concerns may result in delays, modifications, rescheduling, or cancellation.
Delivery Timelines
Published delivery timelines are targets, not absolute guarantees. Delivery may be affected by weather, access, project complexity, editing requirements, platform processing, payment status, quality control, revisions, or third-party availability.
- Essential: target delivery within 24 hours
- Signature: target delivery within 24 hours
- Premier: target delivery within 24 hours
- Elite: target delivery within 48 hours
- Iconic: target delivery within 72 hours
Delivery occurs through SAIRS Client Portal, direct delivery links, Matterport links, email, or another approved method. Some deliverables may become available at different times depending on processing and review.
SAIRS Client Portal & File Access
SAIRS Client Portal may be used for project status, invoices, payment status, file delivery, Matterport links, and project support. Portal access may be provided through user login or guest access using email and booking reference.
You are responsible for keeping login details, booking references, and access credentials secure. SAIRS may restrict or revoke access if misuse, unauthorized sharing, unpaid balance, expired retention, or security concerns are detected.
File Retention
- Standard project files are generally available for 14 days after delivery.
- After the active delivery period, files may be removed from active delivery systems and may no longer be available.
- Invoices and accounting records are retained longer as business records.
- Matterport tours remain active while hosting is active.
Requests for file restoration after the retention period are not guaranteed and may require operational review.
Matterport Terms
Matterport 3D tours are captured by SAIRS using Matterport-compatible equipment and processed through Matterport systems. Matterport platform processing, rendering, hosting, uptime, tour availability, and platform functionality may depend on Matterport systems outside SAIRS direct control.
- Standalone Matterport pricing starts at $249 for up to 1,600 sqft unless otherwise quoted.
- Extra Matterport coverage is $95 per additional 1,000 sqft unless otherwise quoted.
- Included Matterport hosting is currently 1 month for eligible tours.
- Hosting after the included period is $15/month when continued through SAIRS.
- Tour transfer to a client Matterport account may be available when applicable.
- Hotels, resorts, multi-space facilities, large commercial projects, or complex Matterport scopes require operational review and custom pricing.
Revisions, Missing Files & Rework
If you believe a deliverable is missing, incomplete, incorrect, or affected by a quality concern, you must notify SAIRS promptly and provide specific examples. SAIRS will review the issue and determine whether corrective action is appropriate.
Revision requests are not automatically approved. Free revisions, reshoots, refunds, additional edits, or rework may require internal review and may depend on the package purchased, scope, project conditions, access limitations, client instructions, and delivery requirements.
Intellectual Property & Usage Rights
Unless otherwise agreed in writing, SAIRS retains copyright ownership of all photos, videos, scans, edits, project media, source files, and deliverables created by SAIRS.
Upon full payment, clients receive a perpetual, non-exclusive license to use delivered final media for MLS listings, websites, social media, print marketing, advertising, internal business use, and project-related promotion.
SAIRS may use project imagery in portfolio, website examples, social media, case studies, advertising, or marketing unless the client requests otherwise in writing before the project begins.
RAW Files & Source Files
RAW files, source files, project files, editing files, working files, and unedited captures are not included in standard packages unless specifically agreed in writing.
Inspection & Technical Disclaimer
Unless specifically stated in a separate written agreement, SAIRS does not provide engineering opinions, structural certifications, legal determinations, surveying certifications, code-compliance certifications, insurance determinations, or professional engineering services.
Inspection imagery, thermal imagery, maps, scans, videos, reports, and documentation are intended to support evaluation and decision-making and should not replace licensed professional opinions when required.
FAA, Drone & Safety Compliance
All aerial operations are conducted in accordance with applicable FAA rules by FAA Part 107 certified operations. Airspace authorization, Temporary Flight Restrictions, property restrictions, weather, crowds, obstacles, safety concerns, or flight limitations may affect whether aerial work can be performed.
SAIRS may postpone, modify, limit, or cancel aerial operations if required for safety, legal compliance, FAA compliance, property restrictions, or operational judgment.
SMS Communications & Optional Consent
SAIRS may offer optional SMS communications for clients and prospects who provide their phone number and select an optional SMS consent checkbox on SAIRS-operated forms, including the Contact Form and Booking & Checkout Form on https://s-airs.com.
By selecting the optional SMS consent checkbox, you authorize Smart Aerial Solutions LLC (SAIRS) to send SMS messages to the phone number you provided. Messages may include booking confirmations, appointment reminders, scheduling updates, project status notifications, payment and invoice notifications, delivery notifications, customer support communications, review requests, service announcements, and occasional updates regarding SAIRS services.
SMS consent is optional: SMS consent is not required to submit a form, book a service, make a purchase, or receive SAIRS services. SMS consent is separate from required Terms & Conditions acceptance.
Message Frequency
Message frequency varies based on customer activity, booking status, project activity, invoice status, delivery process, support requests, or selected communication preferences.
Opt-Out & Help
You may reply STOP to opt out of SMS messages at any time. Reply HELP for assistance. You may also contact SAIRS at info@s-airs.com or 786-809-8756.
Message & Data Rates
Message and data rates may apply. Wireless carriers are not liable for delayed or undelivered messages.
SMS Opt-In Data Protection
SMS opt-in information and phone numbers collected for SMS communications are not shared, sold, rented, or transferred to third parties or affiliates for marketing or promotional purposes.
Cold Outreach
SAIRS does not use SMS opt-in for cold outreach to numbers obtained from public sources, purchased lists, rented lists, affiliate lists, or third-party lead lists without proper consent.
Email, WhatsApp & Other Communications
SAIRS may communicate by email, phone, WhatsApp, SMS, web chat, client portal, or other channels to respond to inquiries, coordinate bookings, provide support, send invoices, confirm appointments, request project information, deliver files, or manage the client relationship.
You may request to stop receiving optional marketing communications at any time. Some service-related, transactional, legal, billing, support, or project communications may still be necessary to complete or administer your project.
Automation & AI-Assisted Operations
SAIRS may use automation tools, artificial intelligence assistants, CRM systems, workflow platforms, and internal operational systems to assist with communication, scheduling, booking coordination, invoice generation, payment status updates, project status updates, delivery notifications, and customer support.
These tools support business operations and response time. They do not replace SAIRS operational review, final scheduling confirmation, safety judgment, or project delivery responsibility.
Third-Party Platforms
SAIRS uses third-party platforms to operate its website, checkout, payments, invoices, portal, file delivery, communications, Matterport tours, authentication, analytics, storage, and workflows.
- Stripe, PayPal, and eligible wallet options for payments
- Squarespace for website hosting and pages
- GoHighLevel for CRM, client records, communications, booking workflows, and project status
- Netlify for hosted functions, checkout workflows, portal pages, and backend processing
- Google Workspace and Google Drive for business operations, calendar, email, records, and storage
- Adobe PDF Services for invoice PDF generation
- Wave or similar accounting platforms for bookkeeping and financial records
- Firebase or similar authentication services for portal login when used
- Matterport for 3D tour processing, hosting, links, and related deliverables
- Analytics or automation platforms when enabled for approved business operations
SAIRS is not responsible for outages, delays, errors, or availability issues caused by third-party platforms outside of SAIRS direct control.
Privacy
Your use of SAIRS services is also governed by our Privacy Policy. The Privacy Policy explains how SAIRS collects, uses, protects, stores, and shares information related to inquiries, bookings, payments, projects, client portal access, communications, and delivery.

Limitation of Liability
To the fullest extent permitted by law, SAIRS is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from your use of our services, website, portal, deliverables, third-party platforms, or project communications.
SAIRS liability for any claim related to a specific project is limited to the amount paid by the client for that specific project, unless otherwise required by law or agreed in writing.
No Guarantee of Results
SAIRS delivers professional visual, media, documentation, and inspection-support services. We do not guarantee listing performance, property sale price, rental conversion, marketing results, social media results, buyer response, inspection findings, insurance outcomes, engineering conclusions, or business results.
Changes to These Terms
SAIRS may update these Terms & Conditions from time to time. The "Last updated" date reflects the latest version. Continued use of our website, portal, checkout, booking forms, communications, or services after updates constitutes acceptance of the revised terms.
